“SMARTROOF” Colour Coated Roofing Sheets Limited Warranty
Warranty Overview
This warranty covers SMARTROOF Color Coated Roofing Sheets purchased from authorized distributors/retailers having a valid dealer certificate. It provides protection against perforation due to manufacturing defects under normal use for a period of 7 years from the date of manufacture. To get the warranty facilitation, one has to visit the company’s website and register themselves by filling the required details in the form. The registration must be done within30daysfrom the date of purchase of the material to avail warranty on the product. No warranty will be applicable by any means if the registration is not done under 30 days. To claim warranty, the buyer must comply with all specified warranty terms and conditions given below. Please note there is no claim whatsoever if any of the below terms and conditions are not in order.
1. Authorized Purchase:
Ensure the product is marked as “SMART ROOF” X.XX mm (X = thickness). Only products with this marking from authorized sellers are eligible. The tax invoice is compulsory and needs to be submitted with claim request by end consumer. If there is no tax invoice found by the end consumer, no claim will be entertained whatsoever. Warranty has been launched for three products ranges, i.e.Profile,Tiles,Linear only, and applicable on sales from 1stNovember 2024 only, no prior sales will be entertained.
2. Installation: The sheets must be processed and installed as roofing/cladding within three months of purchase by authorized dealers, failure of which will be rejected for any sort of claim.
3. Maintenance Guidelines
Annual Cleaning: Areas not exposed to rain require at least two washings per year with fresh water to maintain quality.

Disclaimer of Other Warranties
Except as expressly stated in this Warranty Certificate, SMART ROOF disclaims, and the Buyer waives, any and all other warranties, whether express or implied, oral or written. This includes, but is not limited to, implied warranties of merchantability or fitness for a particular purpose.
This Warranty Certificate outlines the full extent of the Company’s obligations, and no other warranties are applicable.
Limitation of Remedies and Liability
The Buyer’s sole and exclusive remedy under this warranty is limited to the repair or replacement of the defective portiononly and not the whole portion of the warranted product.TheBuyeragreesthatnootherremedies, liabilities, or claims shall be available, including but not limited to indirect, special, punitive, or consequential damages (such as loss of use, business, profits, sales ,injury to person or property ,or any other incidental losses). All other remedies are expressly waived and excluded. The warranty is applicable for retail segment sales only and not for Project sales.
The maximum liability of the Company, in any circumstance, shall not exceed the invoice value of the product. All costs related to dismantling, installation, reinstallation, and transportation are the Buyer’s responsibility, and the Company holds no obligation for these expenses.

It is a condition of this warranty that the Buyer has fully paid the contract price including taxes for the product.
Warranty Fulfillment Timeline
Upon strict compliance with the claim requirements, the company will proceed to repair or replace the product within 90 days of receiving all necessary documentation and completing an inspection to determine the root cause.
If the Company repairs or replaces the product, the warranty will be considered fulfilled and subsequently terminated. The Company may choose to repair by painting the defective area of the product as per mutual discussion with buyer. The Company’s decision regarding the claim is final and binding on the Buyer.
Entire understanding:
Any and all representations, promises, warranties or statements by the Company’s agents or personnel that varies, conflicts, contradicts or inconsistent in any way from the terms of written limited warranty stipulated here under, shall be given no force or effect and shall be deemed null and void. Any such representations, promises, warranties or statements do not constitute warranties, shall not be relied upon by the buyer and are not part of this limited warranty or of the contract for sale of the Product between the Company and buyer. This limited warranty shall be deemed to be a part of the contract of sale between the Company and buyer for the Products old by the Company to the buyer. The entire agreement and understanding between the Company and the buyer with respect to Product is embodied in this writing.This writing constitutes the final expression of the parties’ agreement with respect to warranties and is a complete and exclusive statement of the terms of that agreement
Warranty Non-Transferability
This Limited Warranty is issued solely to the original Buyer and is non-transferable and non-assignable .If the Buyer becomes insolvent, declares bankruptcy, makes an assignment for the benefit of creditors, or discontinues regular business operations for any reason ,this warranty shall immediately become null and void with no further legal effect.
Non-Waiver of Rights
Any decision by the Company not to exercise its rights or to forgo enforcing any term or condition under this warranty, whether in a single instance or a series of instances, does not constitute a waiver of the Company’s rights. The Company retains the full right to enforce all terms and conditions of this warranty, both before and after any such instance, and no action or inaction by the Company shall alter or waive the rights set forth in this agreement.
Governing Law and Jurisdiction
This warranty, along with the rights and obligations of both the Company and Buyer, shall be governed by and construed in accordance with the laws of India, without reference to conflict-of-law principles. The parties agree that any disputes will be subject to the exclusive jurisdiction of the courts located in Guwahati (Assam), India.
